Site Terms

1. Acceptance

These Site Terms apply to your use of postmortemplan.com and its content (the “Service”). By visiting or using the Service, you accept these Site Terms. Continued use of the Service constitutes acceptance of any revisions.

If you do not agree to these Site Terms, do not access or use the Service.

2. Definitions

These are the definitions used in this agreement.

“Service” means postmortemplan.com, any subdomain operated by Root Pragmatic LLC for it, and any other digital channel through which Root Pragmatic LLC makes this tool available.

“Root Pragmatic LLC,” “we,” “us,” and “our” mean the entity operating the Service, identified in Section 11.

“You” and “your” mean the individual accessing the Service.

3. Not Professional Advice

The Service is an informational and organizational checklist only. It is not legal, tax, accounting, financial, insurance, medical, or other professional advice, and it is not a substitute for a will, trust, advance directive, or any other legal document.

Estate, end-of-life, and financial matters vary by individual circumstance and by jurisdiction, and the law changes over time. Nothing on the Service creates an attorney-client, fiduciary, or other professional relationship. Before making any legal, tax, financial, or healthcare decision, or before relying on any item in the checklist, consult a qualified professional licensed in your jurisdiction.

The checklists, prompts, summaries, and narration on the Service are general in nature, may not apply to your situation, and may be incomplete or out of date. You are solely responsible for how you use them.

The Service is operated from the United States and is intended for use where Root Pragmatic LLC is permitted by local law to make it available. We make no representation that it is appropriate or available for use in any other jurisdiction.

4. Your Data Lives in Your Browser

This section explains how your information is handled. In short: it stays on your device, and we never receive it.

Local storage only. Any progress, notes, or other content you enter into the Service is stored solely within your own web browser. It is not transmitted to, received by, or stored by us. We operate no account system or backend that could hold it. This is described further in the Privacy Notice.

You are responsible for your own data. Because we never hold your data, we cannot recover, restore, back up, or retrieve it. If you clear your browser data, switch browsers or devices, or lose your device, the data may be permanently lost. You are responsible for exporting and safeguarding your own copies. Any file you export may contain sensitive personal and financial information; protect it accordingly.

No guarantee of availability. We may change, suspend, or discontinue the Service, in whole or in part, at any time and without notice. Local browser storage is controlled by your browser and may be cleared by it independently of us.

5. Advertising

The Service displays third-party advertising, including through Google AdSense. We do not endorse, and are not responsible for, any advertised product, service, or advertiser. Your interactions with advertisers and with advertising technology are governed by those parties’ own terms and privacy practices. The collection and use of data in connection with advertising is described in the Privacy Notice.

6. Acceptable Use

This section explains prohibited ways of using the Service.

Personal use. The Service is provided for your personal, noncommercial use.

Access and integrity. You may not use the Service in any manner that could damage, disable, or overburden it or the infrastructure that delivers it. You may not use scraping, crawling, or other automated means to systematically retrieve content, attempt to gain unauthorized access to any system, or interfere with the Service’s operation or security.

Lawful use. You may not use the Service in violation of any applicable law, or to infringe the rights of any third party.

Endorsements and framing. You may not use Root Pragmatic LLC’s name or marks in a way that implies affiliation or endorsement, and you may not frame the Service within another interface, without our express written consent.

7. Third-Party Links and Services

The Service may contain links to, or content delivered by, third parties (including advertising networks and the hosting and font providers used to deliver the page). Unless otherwise stated, we make no warranties regarding those third parties, their websites, or their products or services, and we do not control their privacy or security practices. You should review the policies of any third party you interact with, as their practices may differ from ours.

8. Intellectual Property

Our content. The Service, including its design, code, text, graphics, audio narration, and other content authored by Root Pragmatic LLC, is the copyrighted work of Root Pragmatic LLC. Unless otherwise specified, you may not copy, display, distribute, republish, or create derivative works from such material, except that you may print or export checklist content for your own personal use. This restriction does not apply to content you yourself create.

Trademarks. The trademarks, logos, and marks displayed on the Service are the property of Root Pragmatic LLC or other parties and may not be used without the owner’s written permission.

Copyright claims. It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act. 9. Disclaimer of Warranties and Limitation of Liability

This section disclaims warranties and limits liabilities related to the Service.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Root Pragmatic LLC disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Service or its content is accurate, complete, current, reliable, or error-free.

To the fullest extent permitted by applicable law, Root Pragmatic LLC will not be liable to you or anyone else for any damages of any kind — including direct, indirect, incidental, punitive, or consequential damages, or any loss of data — arising from the use of, inability to use, or reliance on the Service, even if advised of the possibility of such damages. Some states do not allow certain limitations, so some of the above may not apply to you, and you may have additional rights.

10. Miscellaneous

This section describes the governing law, how disputes are handled, and how these Terms may change.

Governing Law. These Site Terms and your use of the Service are governed by the laws of the State of Texas, without giving effect to its conflicts-of-laws principles.

Jurisdiction and Venue. Exclusive jurisdiction and venue for any claim or dispute arising out of or relating to these Site Terms or the Service shall lie in a court of competent jurisdiction in Travis County, Texas, and you consent to that jurisdiction.

Severability. If any provision is held unlawful, void, or unenforceable, the remaining provisions remain in effect to the fullest extent possible.

Waivers. Any waiver must be in writing and signed by an authorized representative of Root Pragmatic LLC. Our delay or failure to exercise a right is not a waiver of it.

Section Headings. Section titles and the italicized introductions are for convenience only and are not part of the agreement.

Changes. We may revise these Site Terms from time to time by posting the revised version on the Service and updating the “Last Updated” date above. Changes take effect when posted.

Survival. Provisions that by their nature should survive termination — including the Intellectual Property, Disclaimer of Warranties and Limitation of Liability, and Jurisdiction and Venue provisions — will continue in effect.
